Justice Roberts
I sure hope Chief Justice Roberts is truly alright. Obviously when a man in his early 50s has apparently a second seizure (he had one 14 years ago), there is reason for concern. So far the Roberts court has been a triumph for conservatives and I think that much has to do with his persuasiveness. Justice Alito has been all that could be expected, but it seems Roberts is the one who is most influential on the new Kennedy swing vote. Another Scalia or Thomas would probably not have been able to shift that center of gravity. Of course, Roberts is expected to have at least two decades to serve on the court so any serious health issue could have a monumental impact on its direction. There is no way President Bush could get another jurist of equal strength through the Democrat Senate and even if Republicans keep the Presidency in 08, I am not overly optimistic on the Senate switching which means his successor would have to find “moderate” candidates and we’d end up with more of a Souter. Roberts is now a real coup and we need him for a long time to come.
